This policy explains what personal information Filigrana Photography (“we”, “us”, “Filigrana”) collects, how it is used and stored, who it may be shared with, and how you can access, correct, or ask questions about it. It applies to real estate agents, property owners, architects, interior designers, builders, and any other person who books, appears in, or otherwise deals with our services.

2.  Personal Information We Collect

Depending on how you interact with us, we may collect:

—  Contact details — name, email address, phone number, business/agency name and role

—  Booking details — property address, listing details, shoot date/time, service requested

—  Billing details — invoicing information and bank transfer records for payments made to us

—  Correspondence — emails, contact form submissions, and Instagram messages

—  Images and video captured during a shoot, which may incidentally include people, vehicles, or other identifying details on or near the property (see Section 5)

We do not collect sensitive information (such as health information) and do not request payment card details — payments are made by direct bank transfer or through our booking platform's own payment processing.

3.  How We Collect Personal Information

We collect personal information directly from you — through the contact form on filigranaphotography.com, our booking platform, email, Instagram, and phone calls or in-person conversation when arranging or carrying out a shoot.

4.  Why We Collect, Hold and Use It

We use personal information to:

—  Respond to enquiries and provide quotes

—  Schedule, deliver, and invoice photography, video, drone, and floor plan services

—  Communicate with you about a booking, including changes and delivery of final media

—  Meet our own record-keeping, accounting, and tax obligations

—  With your consent, feature completed work (which may include a client or agency name) in our portfolio or marketing — see our Photo & Video Licensing Terms for how the images and video themselves are licensed

We do not sell personal information to third parties.

5.  Images and Video of Individuals

Real estate, architecture, and property media can incidentally capture people, neighbouring properties, or vehicles present on or near a shoot location (for example, an open home visitor or a passer-by in a street-level or drone shot). These images are captured for the purpose of marketing the specific property and are not used to identify or profile individuals. If you are the client booking a shoot, you are responsible for ensuring you have the right to have the property photographed and for managing consent from any tenants, occupants, or other people you invite to be present.

6.  Third-Party Service Providers We Use

We use a third-party booking and gallery delivery platform to manage scheduling, invoicing, and the delivery of your final images and video. That platform receives the personal information needed to process your booking — such as your name, contact details, property address, and billing details.

Aside from this platform, we do not share your personal information with any other third party for their own purposes.

7.  Overseas Disclosure

Our booking platform may store or process information outside Australia as part of providing its service. Where this occurs, we take reasonable steps to work only with providers who handle information securely, and we don't disclose more personal information than is necessary to manage your booking.

8.  Website Cookies & Analytics

Our website may use analytics and cookies to understand how visitors use the site (e.g. pages viewed, general location, device type). This information is aggregated and is not used to personally identify you. You can control cookies through your browser settings.

9.  Direct Marketing

We may occasionally contact past clients or enquirers about our services. You can opt out at any time by replying “unsubscribe”, emailing us, or messaging us on Instagram, and we will stop further marketing contact.

10.  Data Storage & Security

Personal information is stored digitally across our booking platform, business email, and cloud storage, protected by password access and, where available, two-factor authentication. No method of electronic storage is completely secure, but we take reasonable steps to protect information from misuse, loss, or unauthorised access.

11.  Data Retention

We retain booking, invoicing, and correspondence records for as long as needed to provide our services and to meet Australian tax record-keeping requirements (currently five years from the relevant transaction). Delivered images and video may be retained for longer for portfolio and archival purposes, consistent with our Photo & Video Licensing Terms.

12.  Access & Correction

You can ask us for access to the personal information we hold about you, or ask us to correct it, by emailing filigranaphoto@gmail.com. We will respond within a reasonable timeframe and may need to verify your identity first.

13.  Complaints

If you have a concern about how we've handled your personal information, please contact us directly at filigranaphoto@gmail.com so we can try to resolve it. If you're not satisfied with our response, you can lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

14.  Changes to This Policy

We may update this policy from time to time as our services or obligations change. The current version will always be available at filigranaphotography.com, with the effective date shown at the top.

15.  A Note on Small Business Status

Filigrana Photography operates as a small business. The Privacy Act 1988 (Cth) has historically exempted small businesses with annual turnover of $3 million or less from most of its requirements, though this exemption has been under active review as part of ongoing Privacy Act reforms, and its status should not be assumed to be settled. Regardless of whether that exemption currently applies to us, we've chosen to follow the practices set out in this policy as good practice.
